Power of Attorney Representation & Requirements

The use of a Power of Attorney (POA) should only be used if there is no other reasonable alternative, however can be used to avoid a delay if a Buyer or Seller is unable to attend settlement. A POA is written authorization to represent or act on another's behalf in certain circumstances. It can be for private matters, business, or some other legal matter. We refer to the person authorizing the other to act is as the principal and the one authorized to act is the agent or the attorney-in-fact.

For a purchaser, the mortgage lender and title company must give their approval on both the use of the POA and the content of the document.

As a preferred alternative to a POA, very often, when a seller is unavailable for settlement, the title company can make arrangements to have their documents signed separately.
